1. Agreement to Terms
By accessing or using playjomo.com (the “Site”), operated by AZYT Global Talent, a Delaware corporation doing business as JOMO Games (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use. If you do not agree with all of these terms, you are expressly prohibited from using the Site and must discontinue use immediately.
2. Intellectual Property Rights & Asset Protection
Unless otherwise indicated, the Site and all content contained therein—including but not limited to game demos, mathematics models, game mechanics, algorithms, software code (source and object), databases, functionality, website designs, audio, video, text, photographs, animations, and graphics (collectively, the “Content”)—as well as the trademarks, service marks, and logos contained therein (the “Marks”), are owned, controlled, or licensed by AZYT Global Talent.
The Content and Marks are protected by United States and international copyright, trademark, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable license to access the Site strictly for your personal, non-commercial, and informational use. No part of the Site, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
3. Prohibited Activities and Unauthorized Usage
To protect our intellectual property and the integrity of our games, you agree not to access or use the Site for any purpose other than that for which we make the Site available. Specifically, you agree not to:
- Scrape or Mine Data: Use any data mining, robots, spiders, scrapers, or similar data gathering and extraction methods to access, acquire, copy, or monitor any portion of the Site or Content.
- Reverse Engineer: Decipher, decompile, disassemble, or reverse engineer any of the software, game demos, math models, or code comprising or in any way making up a part of the Site.
- Create Derivative Works: Modify, adapt, translate, or create derivative works based upon the Site or our game demos, including attempting to replicate our game mechanics or math models for competing products.
- Bypass Security: Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content.
- Frame or Link Unauthorized: Frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Company without express written consent.
4. Nature of the Website and B2B Licensing
AZYT Global Talent is a business-to-business (B2B) game development company serving the global iGaming market. The Site is for informational and B2B demonstration purposes only. We do not offer real-money gambling services directly to consumers on this Site.
- Game Demos: Any playable game demos provided on this Site are strictly for demonstrative purposes and operate solely using virtual, non-redeemable credits.
- Commercial Integration: These Terms and Conditions govern website usage only. They do not grant any rights to integrate, host, distribute, or commercially exploit JOMO Games on third-party operator platforms. Any commercial distribution, API integration, or operator licensing requires the execution of a separate, written Master Service Agreement (MSA) and Software Licensing Agreement directly with AZYT Global Talent.
5. Digital Millennium Copyright Act (DMCA) Notice and Policy
We respect the intellectual property rights of others. If you believe that material available on or through the Site infringes a copyright you own or control, please notify our Designated Copyright Agent using the contact information below.
A notification must include:
- A physical or electronic signature of a person authorized to act for the owner of the allegedly infringed exclusive right.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the allegedly infringing material and where it is located on the Site.
- Information reasonably sufficient to contact you, including your address, telephone number, and email.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the notification is accurate and, under penalty of perjury, that you are authorized to act for the owner of the allegedly infringed exclusive right.
6. Limitation of Liability
To the fullest extent permitted by law, AZYT Global Talent and its directors, officers, employees, or agents shall not be liable to you or any third party for direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if advised of the possibility of such damages.
7. Indemnification
You agree to defend, indemnify, and hold harmless AZYT Global Talent, its subsidiaries, affiliates, and their officers, agents, partners, and employees from any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by a third party due to or arising out of your use of the Site, breach of these Terms or your representations and warranties in them, or violation of a third party’s rights, including intellectual property rights.
8. Dispute Resolution: Binding Arbitration and Class Action Waiver
Please read this section carefully as it affects your legal rights.
- Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, or their breach, termination, enforcement, interpretation, or validity, shall be determined by binding arbitration in the State of Delaware rather than in court.
- Arbitration Rules: The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.
- Class Action Waiver: Disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action. If a claim proceeds in court rather than arbitration, each party waives any right to a jury trial.
9. Governing Law
These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Delaware, applicable to agreements made and to be entirely performed within the State of Delaware, without regard to its conflict of law principles.
